Troupe Terms and Conditions of Use

Welcome to our Terms and Conditions of Use (“Terms”). These terms are an agreement between you and Troupe AI Inc. We recommend reading through all the Terms before using the Troupe application (“App”). Happy reading!

1. TROUPE USER RULES

Before you can access all the Troupe App features, you are required to register for an account ("Account"). The restrictions to create an account are as follows:

  • be at least 18 years of age; and

  • be legally permitted to use the App based on your location.

You can create an Account by registering manually or by using your LinkedIn, Facebook, Twitter or Gmail login. If you create an Account using your LinkedIn, Facebook, Twitter or Gmail, you authorize us to access, display and use certain information from your LinkedIn, Facebook, Twitter or Gmail account such as pictures, location, and information about friends. For more information about what information we use and how we use it, please check out our Privacy Policy.

If you feel the need to leave the Troupe community, you can delete your Account at any time by going to the 'Settings' page when you are logged in and selecting 'Delete account'. Your Account will be deleted immediately and Your Content to be completely removed from the App within ____ days. We will save your profile information for 30 days after deactivation in case you decide to restore your Account. Troupe AI Inc. reserve the right at our sole discretion to terminate or suspend any Account, or make use of any other means available to enforce the Terms, at any time without liability and without prior notice.

We ask that you do not access, tamper with, or use non-public areas of the App or our systems.

2. APP CONTENT

There are three types of content that you will be able to access on the App:

  • content that you upload and provide ("Your Content");

  • content that other Troupers provide ("Member Content"); and

  • content that Troupe AI Inc. provides ("Our Content").

Troupe does not allow the sharing of certain content on our App as we want all Troupers to have a positive user experience. Restrictions apply to content that:

  • contains language or imagery which could be deemed offensive or is likely to harass, upset, embarrass, alarm, or annoy any other member;

  • is obscene, pornographic, violent or otherwise may offend or compromise human dignity;

  • is abusive, insulting or threatening, discriminatory or which promotes or encourages racism, sexism, hatred or bigotry;

  • encourages any illegal or illicit activity including, without limitation, terrorism, inciting racial hatred or the submission of which in itself constitutes committing a criminal offence;

  • is defamatory;

  • relates to commercial activities;

  • involves the transmission of "junk" mail” or  "spam”;

  • contains any spyware, adware, viruses, corrupt files, worm programmes or other malicious code designed to interrupt, damage or limit the functionality of or disrupt any software, hardware, telecommunications, networks, servers or other equipment, or expropriate any data or personal information whether from Troupe or otherwise;

  • itself, or the posting of which, infringes any third party's rights (including, without limitation, intellectual property rights and privacy rights);

Troupe operates a zero-tolerance policy for this kind of content.

Your Content

As Your Content is unique, you are responsible and liable for Your Content and will indemnify, defend, release Your Content. Troupe is not responsible for any claims made in connection with Your Content.

You may not display any personal contact or banking information on your individual profile page whether in relation to you or any other person. This includes but is not limited to names, home addresses, telephone numbers, email addresses, URLs, or other banking details. If you do choose to reveal any personal information about yourself to other users, it is at your own risk. We encourage you to use the same caution in disclosing details about yourself to third parties online as you would under any other circumstances.

As Troupe is a public community, Your Content will be visible to other users of the App all around the world instantly - so make sure you are comfortable with the content you are sharing. In creating an account, you agree that Your Content may be viewed by other members, and any person visiting or who is sent a link to the App. By uploading Your Content on Troupe, you represent and warrant to us that you have all necessary rights and licences to do so. You also automatically grant us a non-exclusive, royalty free, perpetual, worldwide licence to use Your Content in any way. This includes but is not limited to editing, copying, modifying, reformatting, creative derivative works from, incorporating into other works, advertising, distributing and otherwise making available to the general public such Content, whether in whole or in part and in any format or medium currently known or developed in the future.

We may assign and/or sub-licence the above licence to our affiliates and successors without any further approval by you. We reserve the right to remove, edit, limit or block access to any of Your Content at any time, and we have no obligation to display or review Your Content.

Member Content

Other members of Troupe will also share content via the App. Member Content belongs to the user who posted the content and is stored on our servers and displayed via the App.

You do not have any rights in relation to other Member Content, and you may only use the personal information of other users to the extent that usage aligns with Troupe’s purpose of allowing people to connect with one another. You may not use other member information for commercial purposes, to spam, to harass, or to make unlawful threats. We reserve the right to terminate your Account if you misuse member information.

Member Content is subject to the terms and conditions of the Notice and Notice provisions of the Copyright Modernization Act, 2015.


Our Content

Any other text, content, graphics, trademarks, logos, sounds, artwork, user interface, and other intellectual property published on the Troupe App are owned, controlled or licensed by Troupe AI Inc. and are protected by copyright, trademark and other intellectual property law rights. All right, title and interest in and to Our Content remains with us at all times.

We grant you a non-exclusive, limited, personal, non-transferable, revocable, license to access and use Our Content, without the right to sublicense, under the following conditions:

  • you shall not use, sell, modify, or distribute Our Content except as permitted by the functionality of the App;

  • you shall not use our name in metatags, keywords and/or hidden text;

  • you shall not create derivative works from Our Content or commercially exploit Our Content, in whole or in part, in any way; and

  • you shall use Our Content for lawful purposes only.

We reserve all other rights.

3. ADDITIONAL RESTRICTIONS

You agree to:

  • comply with all applicable laws, including without limitation, privacy laws, intellectual property laws, anti-spam laws, equal opportunity laws and regulatory requirements;

  • use your real name on your profile;

  • use the services in a professional manner.

You agree that you will not:

  • act in an unlawful or unprofessional manner including being dishonest, abusive or discriminatory;

  • misrepresent your identity, your current or previous positions, qualifications or affiliations with a person or entity;

  • disclose information that you do not have the consent to disclose;

  • create or operate a pyramid scheme, fraud or other similar practice.

I you see anyone engaging inappropriately or not in accordance to these guidelines, you can report any abuse or complain about Member Content by contacting us. You can also report a user directly from a profile or in chat by clicking the 'Block & Report' link.

4. PRIVACY

For more information on how your personal data is collected, used, and shared, please read our Privacy Policy. By registering for an account, you agree that we can use such data in accordance with our Privacy Policy.

5. THIRD PARTY STORES AND PREMIUM SERVICES

The App may be dependent on and/or interoperate with third-party owned and/or operated platforms and services, e.g., LinkedIn, Facebook, Twitter, Google, etc. (each, a “Third Party Platform”) and may require that you be a registered member of such Third Party Platforms and provide certain account credentials and other information in order to access the App. By using the App, you agree to comply with any applicable terms, conditions or requirements outlined by any provider of a Third Party Platform.

We may make certain products and/or services available to users of the App in consideration of a subscription fee or other fees (“Premium Services”), including the ability to purchase products, services and enhancements, such as personalisation and the ability to extend your matches (“In-App Products”). If you choose to use Premium Services or make In-App Products, you acknowledge and agree that additional terms may apply to your use of, access to and purchase of such Premium Services and In-App Products, and such additional terms are incorporated herein by reference. You may purchase Premium Services and In-App Products through the following payment methods (each, a “Premium Payment Method”): (a) making a purchase through the Apple App Store ®, Google Play or other mobile or web application platforms or storefronts authorized by us (each, a “Third Party Store”), (b) paying with your credit card, debit card, or PayPal account, which will be processed by a third party processor. Please note that for Premium Services and In-App Products you will be billed continuously for the subscription or service until you cancel in accordance with your Mobile Platform Account’s or your Premium Payment Method’s terms. In all cases, we are not responsible and have no liability whatsoever for any payment processing errors (including card processing, identity verification, analysis and regulatory compliance) or fees or other service-related issues, including those issues that may arise from inaccurate account information, or products or goods you obtain through your Mobile Platform Account or Third Party Stores.

Once you have requested a Premium Service or In-App Product, you authorize us to charge your chosen Premium Payment Method and your payment is non-refundable. If payment is not received by us from your chosen Premium Payment Method, you agree to promptly pay all amounts due upon demand by us. If you want to cancel or change your Premium Payment Method at any time, you can do so either via the payment settings option under your profile or by contacting your mobile service provider. Further, if we terminate your use of or registration to the App because you have breached these Terms, you shall not be entitled to a refund of any unused portion of any fees, payments or other consideration.

6. PUSH NOTIFICATIONS

We may provide you with emails, text messages, push notifications, alerts and other messages related to the App and/or Troupe services. After downloading the App, you will be asked to accept or deny push notifications/alerts. If you deny, you will not receive any push notifications/alerts. If you accept, push notifications/alerts will be automatically sent to you. If you no longer wish to receive push notifications/alerts from the App, you may opt out by changing your settings on your mobile device. With respect to other types of messaging or communications, such as emails, text messages, etc., you can unsubscribe or opt out by either following the specific instructions included in such communications, or by emailing us with your request at [insert email].

7. LOCATION ACCESS

The App requires access to your location for you to view certain content and receive other products, services and/or other materials. To make these services and opportunities available to you, the App will determine your location using one or more reference points, such as GPS, Bluetooth and/or software within your mobile device. If you have set your mobile device to disable GPS, Bluetooth or other location determining software or do not authorize the App to access your location data, you will not be able to access such location-specific content, products, services and materials.

8. DISCLAIMER

THE APP, SITE, OUR CONTENT, AND MEMBER CONTENT ARE ALL PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

SHOULD APPLICABLE LAW NOT PERMIT THE FOREGOING EXCLUSION OF EXPRESS OR IMPLIED WARRANTIES, THEN WE GRANT THE MINIMUM EXPRESS OR IMPLIED WARRANTY REQUIRED BY APPLICABLE LAW. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, SHALL CREATE ANY WARRANTY, REPRESENTATION OR GUARANTEE NOT EXPRESSLY STATED IN THIS SECTION.

ADDITIONALLY, WE DO NOT MAKE ANY WARRANTIES THAT THE APP OR SITE WILL BE UNINTERRUPTED, SECURE OR ERROR FREE OR THAT YOUR USE OF THE APP OR SITE WILL MEET YOUR EXPECTATIONS, OR THAT THE APP, SITE, OUR CONTENT, ANY MEMBER CONTENT, OR ANY PORTION THEREOF, IS CORRECT, ACCURATE, OR RELIABLE. YOUR USE OF THE APP OR SITE IS AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. TROUPE AI INC IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER. TROUPE DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS.

NEITHER US NOR ANY OWNER WILL BE LIABLE FOR ANY DAMAGES, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, INCOME, PROFIT OR GOODWILL, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES ARISING OUT OF YOUR ACCESS TO OR USE OF THE APP, SITE, OUR CONTENT, OR ANY MEMBER CONTENT, HOWEVER CAUSED, WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PROPRIETARY RIGHTS INFRINGEMENT, PRODUCT LIABILITY OR OTHERWISE.

THE FOREGOING SHALL APPLY EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU BECOME DISSATISFIED IN ANY WAY WITH THE APP OR SITE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP YOUR USE OF THE APP AND SITE.

YOU HEREBY WAIVE ANY AND ALL CLAIMS ARISING OUT OF YOUR USE OF THE APP OR SITE. IF ANY PORTION OF THIS LIMITATION ON LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN OUR AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

THE LIMITATION OF LIABILITY HEREIN IS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN AND REFLECTS A FAIR ALLOCATION OF RISK. THE APP AND SITE WOULD NOT BE PROVIDED WITHOUT SUCH LIMITATIONS AND YOU AGREE THAT THE LIMITATIONS AND EXCLUSIONS OF LIABILITY, DISCLAIMERS AND EXCLUSIVE REMEDIES SPECIFIED HEREIN WILL SURVIVE EVEN IF FOUND TO HAVE FAILED IN THEIR ESSENTIAL PURPOSE.


9. INDEMNITY

All the actions you make and information you post on Troupe remain your responsibility. Therefore, you agree to indemnify, defend, release, and hold us, and our partners, licensors, affiliates, contractors, officers, directors, employees, representatives and agents, harmless, from and against any third party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable legal fees) suffered or reasonably incurred by us arising as a result of, or in connection with:

  • any negligent acts, omissions or wilful misconduct by you;

  • your access to and use of the App;

  • the uploading or submission of Content to the App by you;

  • any breach of these Terms by you or your Account; and/or

  • your violation of any law or of any rights of any third party.

We retain the exclusive right to settle, compromise and pay any and all claims or causes of action which are brought against us without your prior consent. If we ask, you will co-operate fully and reasonably as required by us in the defence of any relevant claim.

10. MISCELLANEOUS

These Terms, which we may amend from time to time, constitute the entire agreement between you and Troupe AI Inc. The Terms supersede all previous agreements, representations and arrangements between us (written or oral). Nothing in this clause shall limit or exclude any liability for fraudulent misrepresentation.

Troupe AI Inc. has taken reasonable steps to ensure the currency, availability, correctness and completeness of the information contained on Troupe and provides that information on an "as is", "as available" basis. Troupe AI Inc. does not give or make any warranty or representation of any kind about the information contained on Troupe, whether express or implied. Use of Troupe and the materials available on it is at your sole risk. Troupe AI Inc. can not be held responsible for any loss arising from the transmission, use of data, or inaccurate User Content.

You are responsible for taking all necessary precautions to ensure that any material you may obtain from Troupe is free of viruses or other harmful components. Troupe AI Inc. is not responsible for any damage to your computer hardware, computer software, or other equipment or technology including, but without limitation damage from any security breach or from any virus, bugs, tampering, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure or any other technical or other malfunction.

We reserve the right to modify, amend, or change the Terms at any time (a "Change"). If a Change is administered, it will be posted on this page and we will indicate the Effective Date of the updates at the bottom of the Terms. In certain circumstances, we may send an email to you notifying you of a Change. Your continued use of Troupe following any Change constitutes your acceptance of the Change and you will be legally bound by the new updated Terms.

If, for any reason, any of the Terms are declared illegal, invalid or otherwise unenforceable by a court of a competent jurisdiction, then to the extent that term is illegal, invalid or unenforceable, it shall be severed and deleted from the Terms and the remainder of the Terms shall survive, remain in full force and effect and continue to be binding and enforceable.

No failure or delay in exercising any right, power or privilege under the Terms shall operate as a waiver of such right or acceptance of any variation of the Terms and nor shall any single or partial exercise by either party of any right, power or privilege preclude any further exercise of the right or the exercise of any other right, power or privilege.

You represent and warrant that:

By using the App, you agree and acknowledge that Troupe is a global app operating through servers located in a number of countries around the world, including Canada. If you live in a country with data protection laws, the storage of your personal data may not provide you with the same protections as your country of residence. By submitting your personal information, or by choosing to upgrade the services you use, or by making use of the applications available on Troupe, you agree to the transfer of your personal information to, and storage and processing of your personal information in, any such countries and destinations.

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by us without restriction.

11. GOVERNING LAW

Your access to the App, Our Content, and any Member Content, as well as these Terms are governed and interpreted by the laws of Canada, other than such laws, rules, regulations and case law that would result in the application of the laws of a jurisdiction other than Canada. By using the App, you are consenting to the exclusive jurisdiction of the federal courts of Canada and provincial courts of Ontario. You agree that such courts shall have in personam jurisdiction and venue and waive any objection based on inconvenient forum. You agree that you will not file or participate in a class action against us. In the event there is a discrepancy between this English language version and any translated copies of the Terms, the English version shall prevail.

Privacy Policy

Welcome to our Privacy Policy ("Policy"). This explains how Troupe collects, stores, protects, and shares your information, and with whom we share it. We suggest you read this in conjunction with our Terms and Conditions of Use. By downloading and installing our App, you agree that we can collect, transfer, store, disclose and use your information as described in this Policy. Troupe is a global app, and your information will be sent to and used in Canada regardless of the country you reside in.

1. COLLECTION OF INFORMATION

Registration Information

When you download the App and create an account ("Account"), we may collect certain information ("Registration Information") about you, such as name, username, email address, mobile number, gender identity, date of birth, interests, location.

You will also be required to create a password in connection with the registration of your Account. Once you register, you will be able to review and change this information at any time by accessing your “Profile” page. You control your user profile and are able to correct or update your information at any time.

Additional Information

We may ask you to provide your full name, address and email address. You agree that such details may be shared with third parties. We may also collect additional information in connection with your use of Troupe, for example if you use personalisation features. .

If you contact our Customer Support team, we will receive your email address, and may track your IP address as well as the information you send to us to help resolve your query. We will keep records of our communications with you, including any complaints that we receive.

We recommend and encourage you (and all our members) to think carefully about the information you disclose about yourself. We also do not recommend that you put email addresses, URLs, instant messaging details, phone numbers, full names or addresses, credit card details, drivers' licence details and other sensitive information on your profile which is open to abuse and misuse.

When you post information about yourself or use the messaging function, the amount of personal information you share is at your own risk. Please see Section 4 below for more information on who can access what you post on Troupe. If you post anything that is inconsistent with our Terms and Conditions of Use, we reserve the right to terminate your Account.

For safety and security and to ensure you have the best possible user experience, we require users to verify their accounts and might ask for your phone number. We want to make sure you are not a robot! We use a third party provider for account verification who will keep your phone number for up to 90 days for fraud identification purposes across a range of online platforms and services like Troupe’s. We collect and use your phone number on the basis of our legitimate interests identified above and for the prevention of fraud.

If you decide to purchase any of our premium services, we will process your payment information and retain this securely for the prevention of fraud and for audit/tax purposes. Under data protection law, it is necessary for us to collect and process this payment data to enable us to perform our contract with you and our ongoing retention of this data is justified by our legitimate interests set out above.

Data Storage

By using the App, you agree and acknowledge that Troupe is a global app operating through servers located in a number of countries around the world, including Canada. If you live in a country with data protection laws, the storage of your personal data may not provide you with the same protections as you enjoy in your country of residence. By submitting your personal information, or by choosing to upgrade the services you use, or by making use of the applications available on Troupe, you agree to the transfer of your personal information to, and storage and processing of your personal information in, any such countries and destinations.

Geolocation Information

If you turn these features on, when you use your mobile, we will collect information about WiFi access points as well as other location information about your longitude and latitude and may save your device's coordinates to offer certain features to you. This information helps us identify your physical location and we may use it to personalize the App and make it easier for you to interact with other Users.

Our servers automatically record information ("Log and Usage Data") created by your use of the Service, which again helps us to improve our service. Log and Usage Data may include information such as your IP address, browser type, the referring domain, pages visited, access times, your mobile carrier, and search terms. Other actions, such as interactions with Troupe and advertisements, may also be included in Log and Usage Data.

Where you request that your profile is deleted via the app, it is immediately made unavailable and fully deleted within 30 days. Correspondence with our Customer Support team will be retained for longer to allow us to deal with any subsequent questions you may have but will usually be deleted within 6 years if there are no questions.

Information such as payment information, IP addresses, mobile numbers and email addresses are retained for anti-fraud and anti-spam purposes for as long as they are relevant. This is usually determined by the expiry of the payment method.

Device Information

We may collect information about your device when you use the App including the unique device identifier, device model, operating system, and MAC address. In addition, if you permit us to do so, the App may access your device's address book solely in order to add someone to your contacts.

Cookies

These are small data files that are transferred to your computer's hard disk and are a tool that stores information about website visits, recognises you and your preferences each time you visit Troupe. They ensure site functionality and enable us to provide the services our members request.

The cookies we collect enable us to learn how people interact with Troupe, which in turn helps us make a better product for you! Cookies store information about your website visits and can recognize you and your preferences each time you visit the Troupe site. They help us to provide a better service to you!

2. USE OF INFORMATION

Our main goal is to ensure your experience is an enjoyable one! In order to deliver an enjoyable experience to you, we may use your Registration and other information to:

  • offer you our services and features;

  • contact you with information about the App (e.g., updates and new offerings);

  • personalize the App and the content we deliver to you;

  • conduct research and analytics about how you use and interact with the App;

  • resolve disputes between you and other Users; and

  • investigate fraud, protect our legal rights, and to enforce our Terms & Conditions.

3. DISCLOSURE OF INFORMATION

Our policy is to not disclose your Registration Information, except in the limited circumstances described here:

Your Consent – If you consent, we may share or disclose your Registration Information, such as when you use a third party web client or application to access your Account.

Service Providers – We engage certain trusted third parties to perform functions and provide services to us. We may share your Registration Information with these third parties, but only for the purposes of performing these functions and providing such services e.g. information technology companies (hardware and software) which provide services to support our products.

Moderators – To monitor activity on the apps and approve content.

Payment Processing – To facilitate payments for our premium services.

Law and Harm – We will cooperate with all third parties to enforce their intellectual property or other rights. We will also cooperate with law enforcement enquiries from within or outside your country of residence where we are required to by law or to protect the vital interests of a person. This may include preserving or disclosing any of your information, including your Registration Information, if we believe in good faith that it is necessary to comply with a law or regulation, or when we believe that disclosure is necessary to comply with a judicial proceeding, court order, or legal request; to protect the safety of any person; to address fraud, security or technical issues e.g. through anti-spam providers to protect the service from criminal activity or to protect our rights or property or those of third parties. In such cases we may raise or waive any legal objection or right available to us.

Business Transfers – In the event that Troupe or any of our affiliates undergoes a business transition or change of ownership, such as a merger, acquisition by another company, reorganisation, or sale of all or a portion of its assets, or in the event of insolvency or administration, we may be required to disclose your personal data.

Aggregated Information – We may share aggregated information with third parties that includes your personal data (but which doesn’t identify you directly) together with other information including log data for industry analysis and demographic profiling. You may opt-out of receiving marketing messages by using the opt-out mechanisms and links provided in each email.

We ensure these parties must adhere to strict data protection and confidentiality provisions that are consistent with this Policy. Measures are taken to ensure that the data shared is non-attributable to the greatest extent possible.

4. WHAT OTHERS MAY SEE ABOUT YOU

Our App is designed to make it easier for you to connect with other Users and to interact with them. If you register or login to the App using your LinkedIn, Facebook, Twitter or Gmail account, you are authorizing us to access certain LinkedIn, Facebook, Twitter or Gmail account information, including information you make available on the respective social media platforms, your friends list, current location and those friends you have in common with other Users. You also understand that your Troupe profile and other information you make available via the App, including information you provide directly or indirectly, may be viewed and shared by Users with individuals who may or may not be Users or via third party applications in such Troupe’s discretion.

When using Troupe, you should assume that anything you post or submit on the App may be publicly-viewable and accessible, both by Users of the App and non-Users of the App. We want our Users to be careful about posting information that will eventually be made public.

5. REGISTRATION INFORMATION

You may access or modify the Registration Information you provided at anytime or permanently delete your Account. When your Account is deactivated, we take reasonable efforts to make sure it is no longer viewable on the App. For up to 30 days it is still possible to restore your Account if it was deactivated. After 30 days, we begin the process of deleting your Account from our systems. We are not responsible for any information, pictures, comments, or other content that is deleted from our systems resulting from the deactivation of your Account.

To prevent abuse and/or misuse of Troupe by a User following termination or deletion of a profile/Account we shall retain such information as we deem in our sole discretion may be necessary to ensure that User does not open a new Account and profile in breach of our Terms and Conditions of Use and to ensure compliance with all laws and regulations.

Warning: Even after you remove information from your profile or delete your Account, copies of that information may still be viewable and/or accessed to the extent such information has been previously shared with others, or copied or stored by other Users or to the extent such information has been shared with search engines. We cannot control this, nor do we accept any liability for this. If you have given third party applications or websites access to your personal information they may retain such information to the extent permitted under their terms of service or privacy policies.

Removed and deleted information may persist in backup copies for up to 30 days to enable restoration, but will not be available to others in the meantime.

6. AGE POLICY

Although we want as many people as possible to enjoy our creation, you have to be at least 18 years old to use the App. Troupe does not knowingly collect any information about or market to children, minors or anyone under the age of 18. If you are less than 18 years old, we request that you do not submit information to us. If we become aware that a child, minor or anyone under the age of 18 has registered with us and provided us with personal information, we will take steps to terminate that person's registration and delete their Registration Information.

7. POLICY CHANGES

As evolves, we may revise this Privacy Policy from time to time. The most current version of the policy will govern our use of your information. If we make a change to this policy that, in our sole discretion, is material, we will notify you. By continuing to access or use the App after those changes become effective, you agree to be bound by the revised Privacy Policy.

8. SECURITY

Here at Troupe we pride ourselves on taking commercially reasonable security measures to help protect your information against loss, misuse and unauthorized access, or disclosure. We use reasonable security measures to safeguard the confidentiality of your personal information such as secured servers using firewalls.

Unfortunately no website or Internet transmission is ever completely 100% secure and even we cannot guarantee that unauthorised access, hacking, data loss or other breaches will never occur, but here are some handy tips to help keep your data secure:

Please make sure you log out of your Account after use.

Please don't share your social media password with anyone else.

Change your social media password periodically.

If you ever think someone has had access to your social media password, please report it to the relevant social media platform and change your password immediately. We cannot guarantee the security of your personal data while it is being transmitted to our site and any transmission is at your own risk.

9. THIRD PARTY ACCOUNTS

If you have registered with Troupe using a third party social media platform, such as LinkedIn, your profile will be available to all Users of Troupe whether via our App or our partners' websites.

Remember that when you register with a third party, you are also giving them personal information, so we recommend that you read their privacy policies as Troupe does not control how they use their information.

If you have created a Troupe profile through a third party website and you do not want to link your Troupe profile to your profile on the third party website, Troupe cannot amend these settings. Please visit the application settings on your third party website profile and follow the instructions to remove the Troupe access permissions.

We only use the APIs, OAuth Tokens, Widgets, or other means provided by the applicable Social Media Account to integrate your Social Media Account with our App. As such, we only receive the limited information that each Social Media Account permits to be transferred.

10. YOUR PRIVACY RIGHTS

Our privacy guidelines are in accordance with the Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c. F.31. If you wish to find out about any rights you may have underc. F.31, you can write to us at email.

From time to time we may disclose your contact information to third parties to allow them to market their products or services to you or for other marketing purposes. This may be information we received from you offline and online. If you want us to stop further sharing your email contact information with third parties (if we have your email contact information), you may notify us at email. Please follow the instructions provided to you by third parties to unsubscribe from their messages. If you have opted-out as described above, and thereafter you chose to use a service or promotion that requires us to contact you or share your information with a third party, then your previous opt-out preferences will not apply to such service.

11. YOUR UK AND EU RIGHTS

We urge you to take steps to keep your personal data safe (including your password) and to log out of your account after use. If you lose your password or give it out, or another service provider that you use suffers a data breach and you have used the same credentials with that service provider as you have with Troupe, your personal data may be compromised.

We may use material that you post on the open access areas of Troupe in advertising and promotional materials on our partner sites and partner products. We believe these uses are in enable us to improve our site and better cater the user experience to meet your needs. We also use your personal data to resolve disputes, troubleshoot problems and enforce our Terms and Conditions of Use.

12. Governing Law

Your access to the App, Our Content, and any Member Content, as well as these Terms are governed and interpreted by the laws of Canada, other than such laws, rules, regulations and case law that would result in the application of the laws of a jurisdiction other than Canada. By using the App, you are consenting to the exclusive jurisdiction of the federal courts of Canada and provincial courts of Ontario. You agree that such courts shall have in personam jurisdiction and venue and waive any objection based on inconvenient forum. You agree that you will not file or participate in a class action against us. In the event there is a discrepancy between this English language version and any translated copies of the Terms, the English version shall prevail.
